Tengo una seria duda sobre los nombramientos de tutor hechos ante notario. Me ha llegado el caso de un matrimonio separado legalmente y ahora divorciado y con patria postestad a favor de la madre y guardia y custodia compartida. EStando los padres en proceso de divorcio, la madre nombró tutor de su hijo (no declarado incapaz legalmente pero lo será) a favor de su otro hijo y su hermana. El padre al pedir un certificado de nacimiento para el divorcio se encuentra con que en el margen de nacimiento aparece el nombramiento de tutor. Esta persona me pregunta si puede la madre unilateralmente nombrar un tutor para su hijo si no es incapaz sin su consentimeinto, que en este caso seria negativo pues el padre ha pedido la patria potestad de su hijo porque según él su madre no lo cuida y además se ha marchado a vivir fuera de la isla por lo que su padre no puede verlo. Qué puedo contestarle? Están informados los notarios de todo el proceso de divorcio o cualquier otro proceso cuando nombran un tutor?. Es que me he encontrado con casos de nombrar un tutor de un incapaz y al poco tiempo se rectifica y se nombra a otro porque el primero sólo se queria aprovechar del incapaz....

	¿Existe en la inscripción de nacimiento del que será declarado incapaz inscripción marginal en la que se refleje que la patria potestad la ejerce en exclusiva la madre en virtud de xxxxx? Hay que recordar que, aunque teóricamente el Notario es garante de la legalidad, ello no sustrae al Encargado del RC de su función calificadora, previa a la inscripción (en su caso).

	No existe ninunga mención a la patrica potestad en el margen del nacimiento del hijo (mayor de edad) es por ello por lo que el padre se queja de que se haya nombrado un tutor a su hijo sin su consentimiento. No se si yo como auxiliar administrativo de un Ayuntamiento pequeño y encargada de llevar todo el Juzgado de Paz sola tengo alguna función calificadora al respecto. De todas formas he planteado esta cuestión porque por lógica creo que los notarios antes de elevar a publico el nombramiento de tutor deberian informarse de la situación legal o al menos tener el consentimiento de ambos padres. No se si estoy en lo cierto y si es así, debo comunicarle al notario estos hechos? Gracias por vuestra respuesta

Las competencias de los Registros Civiles delegados. Limitaciones funcionales en materia de calificación. 1. La falta de una específica formación jurídica, como exigencia orgánica, en los Jueces de Paz es lo que justifica las limitaciones funcionales a que quedan constreñidos los Registros Civiles delegados, conforme a lo dispuesto en los trascritos artículos 46 y 47 del Reglamento del Registro Civil. El hecho de que, salvo las excepciones habilitadas por el artículo 46, no puedan extender los Jueces de Paz en los Registros delegados ningún otro asiento «sin recibir instrucción particular y por escrito del Encargado, solicitada y despachada inmediatamente, la cual será archivada con los demás antecedentes relativos al asiento, reservándose minuta el Encargado», supone residenciar la función de calificación en tales casos en el Juez Encargado del Registro Civil de que dependa el delegado, el cual inscribirá bajo los criterios de calificación y con arreglo a la minuta del asiento que le haya comunicado el Juez Encargado.

	Aunque el mensaje es antiguo, no me resisto a contestar.Por lo que entiendo de la pregunta, la madre no ha nombrado tutor, ya que el único que puede hacerlo es el juez. Lo que ha hecho es declarar su preferencia por una determinada persona (art. 223 Cc), para el caso de que su hijo necesite tutor en el futuro. Esto puede tanto el padre como la madre unilateralmente. Si en el futuro el juez decidiese someterlo a tutela y nombrarle tutor, deberá sopesar esta declaración y la que en su caso haga el padre, conforme a los arts. 224-226 y 234-235 Cc (especialmente, en este caso, el 225). Si hay padre no privado de la patria potestad, corresponderá al padre el ejercicio de ésta, y no el nombramiento de tutor. Esto sólo tendrá lugar si los dos padres faltan.
